Harry did not "die", so nor did the soul part. Also, (spoiler alert; don't know if wewe have seen this movie sorry if wewe haven't) in DH 2, when Dumbledore says that Harry must die, he means it. But not necessarily. When Voldemort kills Harry in the Forbidden Forest with the Avada Kedavra spell, and wewe see that he is alive at King's kuvuka, msalaba with Dumbledore, wewe are like, "why isn't he dead?!" The answer is, he isn't dead because the spell didn't destroy him. It destroyed the soul piece inside of him. When Voldemort killed Lily Potter, the piece of his sould latched itself onto the first concealable living thing it could find-Harry himself, therefore making Harry the horcrux that Voldemort never meant to make, and he never knew it. when Voldy tries to kill Harry, he destroys the soul inside him instead. wewe see, when the trio destroys the objects in order to kill the soul parts inside them, they do not actually destroy the objects themselves-just the soul. For example, when they stabbed the cup, the cup stayed a cup-the cup itself was not destroyed, merely the soul piece. so if Harry didn't "die" (Fawkes healed him quickly), niether would the Horcrux, and that is what happened in CoS.
